Start with the distinction

A nonprofit corporation is not automatically tax exempt

State law creates the entity. Federal law determines whether it qualifies under a section such as 501(c)(3), (4), (5), (6), or (7). Charitable-solicitation registration and state income, sales, and property tax treatment may require additional filings.
